Colette L. Kopon Obtains Win in the Northern District of Indiana
Colette L. Kopon wins summary judgment in favor of Saint Mary’s College in the Northern District of Indiana. At issue were the College’s tremendous efforts to accommodate an employee seeking to return from a leave of absence under the Family and Medical Leave Act by creating a new position for her that not only accommodated her medical restrictions, but that she agreed was preferable to her prior position. Ms. Kopon presented oral argument on the motion in December 2019 and the Court ultimately agreed that the plaintiff did not have a right to reinstatement under the FMLA because she was unable to perform the essential functions of her job.
